The evolution of family and its relationship with legal systems
Currently, the style and shape of human life are rapidly changing, leading to a corresponding evolution in the concept of family. Throughout history, social and legal modifications have occurred in tandem with such changes, dating back to ancient Rome.
Initially, the Roman family was based on agnate ties, which meant that individuals were subject to the authority of the father (pater familias). The family consisted of those related through the male line of descent, with little emphasis on blood ties. Over time, as society transformed, cognate kinship became increasingly significant. Cognate kinship emphasizes blood ties, or the descent of one person from another, and was primarily reflected in inheritance law.
Today, globalization and advancements in digital ICT tools are contributing to further changes in the society, shaping the form and quality of human relationships, which are becoming more virtual than real. This shift has had a significant impact on the modern family.
The 13th International Polish-Spanish Conference on the European Legal Tradition will provide an international forum to discuss these changes, exploring the role and place of the family in historical and contemporary society, as well as its relationship to legal frameworks.
